Denne paragrafen gir borgerne rett til å kunne avgjøre sin sak i en domstol. Den bestemmer også at domstolen skal være rettferdig, Uavhengig og  upartisk. Den krever videre at norges myndigheter skal sørge for dette. Men ingen i norges myndigheter har rettet på domstolens manglende evne til å være upartisk. Dette gjør at alle tiltalt i en sak blir også dømt etter tiltale. Dette helt uavhengig om han er skyldig eller ikke.

§ 96 envær har rett til å bli ansett som uskyldig
